ZTM Warszawa announced that after re-evaluating the offers for the acquisition of 213 new trams, it decided to exclude Hyundai Rotem’s offer based on the submission by the contractor of documents proving the temporary ban to participate in public procurement procedures. The ban on Hyundai Rotem was confirmed by a Court order issued in South Korea, informs ZTM Warszawa.
We remind that in February 2017 ZTM Warszawa public transport company launched a tender for the purchase of 213 new trams.
ZTM Warszawa’s firm order consists of the delivery of 123 trams (in the first phase): 85 bidirectional trams and 18 unidirectional trams with low floor and a length of 33 m and twenty 24-m long trams. The option for another 90 trams includes 45 bidirectional trams and 45 unidirectional trams, all with a length of 33 m.
The most important selection criterion of the tender is the price (53%), followed by the maintenance activity level for the first 1 million km (20%), energy consumption (9%), rail impact (5%) and low floor area (3%).
However, the tender has already been canceled twice. The first time, the winner had been declared Škoda Transportation’s offer. After that, the tender was canceled on the grounds that Škoda’s offer exceeded the estimated budget of ZTM Warszawa of PLN 2.3 billion (EUR 538 million). Consequently, it was decided to resume the procedure with re-evaluating the offers submitted by the other companies.
Thus, the valid offers were those submitted by Hyundai Rotem, Stadler-Solaris consortium and Pesa. Offers submitted by Hyundai Rotem and the Stadler-Solaris consortium were then rejected and the entire tender was canceled again in March 2018.
The reasons for the rejection of the offer submitted by the Stadler-Solaris consortium are still not conclusive, but the company has, in the meantime, demanded to re-establish its offer.
Thus, the only contractor valid to bid for the new trams was the Polish rolling stock manufacturer Pesa, but the offer submitted exceeds the financial capabilities of ZTM Warszawa. As a result, budget overruns have led to the cancellation of tender procedures.
But things do not stop here because Hyundai Rotem has said it will again challenge the decision of rejecting its offer. This will be difficult because, according to ZTM Warszawa, this ban is a precautionary measure, mentioned in the Public Procurement Act, which results in exclusion of a contractor from the tender procedure.
In turn, ZTM Warszawa promises to resume a new tender procedure after completing all the formalities.
