Challenging tender in Warsaw: bids for 213 new trams, rejected again

According to the latest information in the Polish press, ZTM Warszawa decided, at the middle of March, to cancel again the tender for the procurement of 213 new trams. The decision is surprising because at the beginning of March, Warsaw Court of Appeals declared invalid the first decision of Warsaw Public Transport Company, ZTM Warszawa, of cancelling the tender. Thus, according to the decision of the Court of Appeal, the tender had to be resumed and ZTM Warszawa had to re-assess the received bids. Hyundai Rotem, Stadler-Solaris consortium and Pesa were the companies still running in the tender.

The offers submitted by Hyundai Rotem and Stadler-Solaris consortium were rejected and the whole tender was cancelled again. The representative of the Korean manufacturer has already announced they would contest the decision of Warsaw public transport company.

The Polish press writes that the decision to reject Hyundai Rotem’s bid was the result of incompatibility with the Polish legislation on public procurement. The reasons why the bid submitted by Stadler-Solaris consortium was rejected are still unknown. However, the consortium had asked for a re-establishment of its offer.

Consequently, the only valid bid still in competition was that of Pesa, worth PLN 2.722 billion (EUR 647.9 milion), which is a lot more than the budget of PLN 2.323 billion (EUR 538 million) set by ZTM Warszawa. However, Pesa’s offer has also been rejected and ZTM Warszawa’s decision on when the tender will be resumed or whether there will be a change of the technical specifications is still unknown.

In the first tender, the bid submitted by the Czech rolling stock manufacturer, Škoda, was declared winner, but the tender was cancelled on grounds that Škoda’s bid of PLN 2.72 billion (EUR 647.4 million) was over the budget.

The most important tender criterion is the price (53%), followed by the level of maintenance for the first 1 million km (20%), energy consumption (9%), rail impact (5%) and low-floor area (3%). ZTM Warszawa’s firm order consists in the delivery of 123 trams (in the first phase): 85 bidirectional trams, 18 unidirectional trams with low-floor and 33 m-long and twenty 24-m long trams. The option for another 90 such vehicles includes 45 bidirectional trams and 45 unidirectional trams, all 33-m long.
