On 3 November, 2016, Romanian President Klaus Iohannis signed the decree on the promulgation of the Law on rail system integration in the single European rail area.
The draft law was passed by the Supreme Council of National Defence on 27 July.
Directive 2012/34/EU of the European Parliament and of the Council on the establishment of the single European rail area includes regulations on the norms applicable to rail infrastructure management and rail transport activities of operators and criteria applicable to the issue, renewal or amendment of the authorisations of rail companies. Also, the Directive sets the principles and the procedures that apply in order to set and collect the track access charges and the allocation of rail infrastructure capacities. The deadline for transposing Directive 2012/34/EU was 16 June 2015, a deadline that was exceeded. In February 2016, the Romanian authorities notified to the EC representatives the stage of transposition of the Directive on the elaboration of the normative act and its placing into the approval circuit.
Thus, in the answer transmitted (on April 26, 2016) to the European Commission, Romania committed to adopt in the Parliament the draft law on the transposition of Directive 2012/34/EU by October 2016. The assumed intermediary deadline for approval of the project by the Government was May 2016.
In July 2016, the Romanian Ministry of Transport said that “the delay of the submission to the approval by the Government of the draft law was caused by the complexity of the inter-ministerial approval process necessary to guarantee a fair transposition of the Directive into the Romanian law”
