Common EU refund and compensation form for travellers

Compensation form for travellers. The European Commission has decided to use a single EU-wide passenger reimbursement and compensation form, which will enter into force at the beginning of July.

The establishment of a single form of the compensation form was decided under Regulation 494/2024 which can be found here.

“In accordance with Articles 18(7) and 19(6) of Regulation (EU) 2021/782, passengers are entitled to submit their claims for reimbursement and compensation using a common form. However, railway undertakings must not reject a claim for reimbursement solely on the grounds that the form has not been used by the passenger. The use of the form must enable passengers to provide railway undertakings with all relevant personal data and details of the journey that are required, thus facilitating the processing of claims for reimbursement and compensation by these undertakings,” the justification for the legislation reads.

Common form for reimbursement and compensation

For reasons of transparency and to facilitate passenger claims, requests for reimbursement and compensation should be integrated into a single common form, on which passengers should specify whether they request reimbursement, compensation or both.

In order to simplify the procedure for passengers to request compensation and/or reimbursement and to ensure its accessibility, passengers should be able to submit the common form for claims for reimbursement and compensation either as a physical document or by electronic means.

Compensation form for travellers

In order to encourage the use of the common form for reimbursement and compensation by travellers, the Commission should make the form available in all official languages of the Union on its website, including in a version accessible to disabled persons and persons with reduced mobility.

The adoption of the form takes into account citizens’ rights regarding data protection and the processing of personal data, the act says.
