The Regional Court of Vilnius rejected the complaint filed by Lietuvos Gelezinkeliai, which claimed money from DB International for an inadequate design of the Kyviskes-Valciunai section of the Vilnius bypass. Accordingly, DB International will not be obliged to pay EUR 5.9 mln.
Lietuvos Gelezinkeliai claimed that the technical project of the bypass had not covered all the required works. Consequently, the Lithuanian company had to pay for additional works from its own resources, which would not be compensated from the funds obtained from the European Union for the project. The Lithuanian railway operator claimed that all additional expenses, as estimated by the main contractor Kauno Tiltai should be covered by DB International.
However, the Lietuvos Gelezinkeliai intends to contest this decision.
